These Terms of Service ("Terms") govern your use of Earnings Alert ("the Service"), operated by Earnings Alert ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Service Description
Earnings Alert is a monitoring tool that tracks earnings announcements from the Australian Securities Exchange (ASX) and New Zealand Exchange (NZX). The Service uses AI to extract key financial metrics, generate summaries, and send alerts to subscribers based on their watchlist preferences.
2. Account Responsibilities
- You must provide a valid email address when registering
- You are responsible for maintaining the security of your account password
- You must not share your account credentials with others
- You must notify us immediately if you suspect unauthorised access to your account
- You must be at least 18 years old to create an account
- We may suspend or terminate accounts that violate these Terms
3. Subscriptions and Billing
Earnings Alert offers three subscription tiers:
- Free -- basic access with limited features (5 watchlist companies, 90-day history, daily digest only, 24-hour delay on announcements)
- Pro Lite ($20/month) -- expanded features including 25 watchlist companies, real-time email alerts, 2-year history, and CSV export
- Pro ($80/month) -- full access including unlimited watchlist, Telegram alerts, Watch All mode, and unlimited history
Billing terms:
- Paid subscriptions are billed monthly through Stripe
- You can cancel your subscription at any time from your dashboard; access continues until the end of the current billing period
- We do not offer refunds for partial months
- We reserve the right to change pricing with 30 days' notice to existing subscribers
- Failed payments may result in your account being downgraded to the Free tier
4. Not Financial Advice
Important Disclaimer
Earnings Alert is an information service only. Nothing provided by the Service constitutes financial advice, investment advice, trading advice, or any other form of professional advice.
- AI-generated summaries and sentiment analysis are automated and may contain errors or inaccuracies
- Financial metrics extracted from announcements may be incomplete or incorrect
- ASX data is subject to a 20-minute delay on the public feed
- You should always verify information against the original source documents
- You should consult a qualified financial advisor before making investment decisions
5. Data Accuracy
We strive to provide accurate information, but we make no guarantees regarding:
- The accuracy, completeness, or timeliness of announcement data sourced from ASX and NZX
- The accuracy of AI-generated summaries, sentiment analysis, or extracted financial metrics
- The availability or uptime of the Service
- The delivery or timing of email or Telegram alerts
Original announcement PDFs are the authoritative source of financial data. Our summaries are provided for convenience only.
6. Acceptable Use
You agree not to:
- Scrape, crawl, or programmatically access the Service beyond the intended user interface and API
- Redistribute, resell, or republish content from the Service without permission
- Use the Service to send spam or unsolicited communications
- Attempt to gain unauthorised access to other users' accounts or our systems
- Interfere with or disrupt the Service's infrastructure
- Use the Service for any illegal purpose
- Create multiple free accounts to circumvent tier limitations
7. Intellectual Property
The Service, including its design, features, and AI-generated content, is owned by Earnings Alert. Original announcement documents remain the property of their respective issuers and exchanges. You may use the Service and its outputs for your personal or professional investment research, but may not redistribute our summaries or analysis commercially.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind
- We are not liable for any investment losses, missed opportunities, or financial damages arising from your use of or reliance on the Service
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability to you for any claims arising from the Service shall not exceed the total fees you have paid us in the 12 months prior to the claim
9. Termination
- You may delete your account at any time by contacting us at support@earningsalert.app
- We may suspend or terminate your account if you violate these Terms, with or without notice
- Upon termination, your right to use the Service ceases immediately
- If you have an active paid subscription when we terminate your account without cause, we will refund any unused portion of your current billing period
10. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify you by email or by posting a notice on the Service. Your continued use of Earnings Alert after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.
